  • Tenders are invited for desg1 Review of APEC Cross-Border Privacy Rules (CBPR) System - Perspectives of Noncbpr Participating Firms 3.1 Description of Services 1. Firm survey Conduct a survey of firms based in five economies (Japan; Korea; Singapore; Chinese Taipei and the United States) to understand the benefits and effectiveness of mechanisms they used to facilitate crossborder data flows, including firms‟ experiences with different privacy certification systems. Specific areas to be covered include: firms‟ personal data use, policy and regulations; firms‟ perspectives on privacy, opportunities and challenges in regional/cross border data transfer; firms‟ perspectives on effectiveness and cost of certification mechanism; and firms‟ awareness and perception on APEC CBPR. Firms to be surveyed must be either controller or joint controller of data, 2 and regularly transfer personal data across borders. They must come from different industry sectors and of different sizes (i.e., MSMEs, large enterprises and multinational corporations) to ensure that relevant and diverse views can be collected. Contractor must indicate that it can meet these essential requirements. Furthermore, a clear sampling framework must be provided in order to assess the external validity of the survey. At least 100 such firms should be surveyed in each of the five economies. 2. Follow-up interviews Based on the survey responses, carry out follow-up interviews with selected firms to gain deeper insights on issues pertaining to cross-border data flows, and therefore complement the survey responses. The questions for the follow-up interviews should aim to gather answers that complete the responses provided by the survey questionnaire, taking into account the objectives mentioned above. Ideally, semi-structured interviews should be employed to allow focus on a particular topic, and at the same time, enable participants to share new information, which the interviewers may seek additional materials on. At least 5 firms of diverse background (i.e., industry and size) should be interviewed in each of the five economies. Contractor must be able to tap on its own networks for the purpose of identifying, arranging and conducting survey and interviews with firms in the five economies. The capacity to independently and successfully implement the proposed interviews should be explained in the submitted proposal. PSU will be providing the preliminary set of questions to the selected Contractor. However, the Contractor is expected to improve on them to facilitate the conduct of the survey and interviews. [Please also refer to RFP Schedule 5 - Evaluation Criteria] 3.2 Expected Outputs, Milestones and Services Delivery Dates The Contractor will provide the following deliverables: a) Inception Report, identifying and proposing the methodology, a work plan for the survey and follow-up interviews (e.g., timeline for the conduct of survey and interviews), draft survey/interview questionnaire, and a proposed outline of the Final Report. It should also have a clear sampling framework and information on how firms to be surveyed and interviewed would be identified (e.g., randomized selection from business directory). Additionally, it should indicate how the agreed number of firms to be surveyed and interviewed would be met/achieved (e.g., utilization of multiple modes such as online and phone). b) Draft Report 1, containing project updates, final survey/interview questionnaire (English and local language translations), results of questionnaire pre-testing, and any preliminary survey results for review by the PSU
